In June 2001 the 1971 Fund Administrative Council instructed the Director to take a flexible approach on the issue of the Fund’s recovery of its legal costs from a group of claimants who had claims relating to alleged damage to asbestos roofs pending in court and who perceived the question of costs as an obstacle to them withdrawing their claims from the proceedings.
