In October 1998 the 1971 Fund Executive Committee, noting that the spill emanated from a hose belonging to the terminal, which had ruptered at a distance of 40 metres from the vessel’s manifold, considered that the maritime transport of the oil had been completed and that the oil could not be considered as being carried by the vessel at the time of the spill. The Committee therefore decided that the incident fell outside the scope of application of the 1969 Civil Liability and 1971 Fund Conventions.
