In October 1998 the 1971 Fund Executive Committee considered that, on the basis of the information which was available prior to the commencement of the oil removal operations, it was reasonable to assume that substantial quantities of oil remained on board the vessel and that it was therefore resonable to take measures to remove the oil. For this reason the Committee decided that claims for compensation in respect of costs associated with these operations would be admissible in principle, even if no significant quantity of oil was found in the vessel’s cargo tanks.
