In June 1996 the 1971 Fund Executive Committee, noting that a significant quantity of oil remained in the wreck, took the view that it was not possible to make any reasonable estimate as to the total amount of the claims arising out of the incident. The Committee therefore decided that for the time being the Director was authorised to make payments of 25% of the damage or loss actually suffered by each claimant, as assessed by the experts of the Fund at the time the payment was made. The Director was instructed to obtain as much additional information as possible on the estimated total amount of claims so that the percentage could be reviewed by the Committee at its next session.
