In April 1997 the 1971 Fund Executive Committee considered a claim for loss of profit by a claimant located in the area affected by the oil spill who manufactured and distributed postcards of local scenes to various tourism-related retail businesses, mainly in the affected area. The Committee recognised that the claimant’s business formed an integral part of the economic activity of the affected area and that the product was specifically targeted at tourists. However, since the claimant did not sell his product directly to tourists but to retail businesses which in turn sold their postcards to tourists, the Committee considered that there was not a reasonable degree of proximity between the alleged loss and the contamination and therefore decided that the claim was not admissible.
