In June 1996 the 1971 Fund Executive Committee considered the admissibility of a claim by a shellfish processor located 80km by road to the north of the area covered by the fishing ban imposed by the United Kingdom Government. The Committee decided that the claim was admissible in principle since there was a reasonable degree of proximity between the contamination and the alleged loss by virtue of the businesse’s geographic proximity to the affected area, its high dependence on supplies from the affected area, its limited sources of alternative supplies and it having been an integral part of the economic activity of the area affected by the spill.
