In February 1996 the 1971 Fund Executive Committee, in noting that claims for compensation had been made against the master of the Aegean Sea, drew attention to Article III.4 of the Civil Liability Convention, which stated that no claim for compensation could be made against the servants or agents of the (ship) owner. The Committee took the view that claims for compensation could not be brought against the master under the Conventions or otherwise since he clearly fell within the concept of servants or agents.
