Decisión nº: 000401
In October 1994 the 1971 Fund Executive Committee considered a claim by a company involved in salmon farming in western (mainland) Scotland for the costs of mobilising personnel and equipment to be available for preventive measures if oil were to threaten a farm just outside the exclusion zone established by the United Kingdom Government where the claimants salmon were being reared under contract by a Shetland based company. The Committee considered that the care of the fish was the primary responsibility of the company contracted to rear the fish, which had in fact taken reasonable preventive measures and had been compensated. The Committee rejected the claim on the grounds that the activities of the owner of the fish at least partly duplicated the efforts of the contractor and were therefore not justified.
