In May 1994 the 1971 Fund Executive Committee instructed the Director to continue his examination of whether the Fund should take recourse action against the owner of the other vessel involved in the collision and whether there was any fault or privity on the part of the owner of the Taiko Maru which would deprive him of the right to limit liability.
