In October 1985 the 1971 Fund Executive Committee agreed a procedure for future incidents whereby the Japan P&I Club would guarantee the payment of the shipowner’s limitation amount into the court, if and when the Fund requested such payment, and the Club would also guarantee to refund the amounts paid by the Fund in compensation arising from a particular incident if it were established that the shipowner was not entitled to limit his liability.
