In October 1991 the 1971 Fund Executive Committee noted that claims by the Italian Government included £45 million for presumed damage to the marine environment and that a claim had been submitted by the region of Liguria for £90 million, a major part of which related to environmental damage. It was noted that the Director had opposed the claims and that the Court of first instance in Genoa had invited the parties to submit pleadings on the issue. It was further noted that some of the plaintiffs had asked the Fund whether, if claims for environmental damage were inadmissible under the Conventions, claimants were entitled to compensation from the shipowner outside the Conventions, on the basis of national law. The Committee decided that this important matter would have to be considered further at an extra session to be held later in 1991.
