In June 1997 the 1971 Fund Executive Committee considered a claim by a civil engineering contractor for losses resulting from lack of work from local authorities (on which the company was dependent) that, in focusing on the clean-up operations, had not placed any orders due to lack of funds. The Committee considered that the claimant’s loss was only indirectly caused by contamination in that it was due primarily to decisions by local authorities based on financial constraints. The Committee took the view that there was not a sufficient degree of proximity between the claimant’s loss and the contamination and therefore rejected the claim.
