In February 1996 the 1971 Fund Executive Committee, in a private session at which only representatives of 1971 Fund Member States were present, decided to uphold its previous decision not to challenge the shipowner’s right to limit liability, since no new information had become available to indicate that the Fund’s prospect of a successful recovery had increased.
