In October 1995 the 1971 Fund Executive Committee considered 13 unquantified claims for alleged injuries such as respiratory conditions resulting from the inhalation of oil vapour and skin complaints resulting from contact with oil. The Committee took the view that, in the light of the discussions at the 1969 International Conference which adopted the 1969 Civil Liability Convention, the Convention covered in principle personal injury caused by contamination whereas personal injury resulting from other causes was not admissible. The Committee reiterated its previous position that exposure to health risks and anxiety would not fall within the defintion of pollution damage and could not therefore be accepted.
