In May 1994 the 1971 Fund Executive Committee, in a private session at which only the delegations representing 1971 Fund Member States were present, rejected a claim by a smolt supplier (Landcatch) on the grounds that the alleged losses could not be considered as damage to property rights and that the losses were not caused by contamination, but due to an unwillingness of customers to conclude contracts for delivery of smolt and the supplier’s lack of adequate alternative markets. The Committee also took the view that the smolt rearing activity was not in reasonable geographic proximity to, and did not form an integral part of the economic activity of, the affected area.
