In March 1993 the 1971 Fund Executive Committee instructed the Director to follow the investigations being carried out into the cause of the incident in the context of the criminal proceedings and the administrative enquiry and to advise the Committee whether the Fund should take legal action to break the shipowner’s right of limitation and whether it should take legal action against any person (other than the owner) for the purpose of recovering any amount which the Fund may have to pay in compensation to victims.
