In June 2009 the 1992 Fund Executive Committee noted that in March 2009 the Civil Court of Bordeaux (France) had rendered a judgement in respect of a claim by the owner of a health spa and hotel located near Biarritz for loss of income incurred as a result of the Prestige incident. It was noted that the 1992 Fund had assessed the losses on the basis of the claimant’s results between 2000 and 2002, which had given an amount significantly lower than that claimed, whereas the claimant had based his claim on a business plan. It was also noted that the Court had agreed with the Fund’s assessment. It was further noted that the Court had recognised that any payment of compensation in respect of the Prestige incident should currently be limited to 30% of the assessed loss.
