In April 1997 the 1971 Fund Executive Committee instructed the Director to investigate the circumstances leading up to the spill, which was caused by the overfilling of a cargo tank. He was also instructed to examine whether the incident fell within the scope of application of the 1969 Civil Liability and 1971 Fund Conventions in the light of the position taken by the Fund in previous cases.
