In October 1999 the 1971 Fund Executive Committee, noting that it might be argued that since the pollution damage in this case arose out of a towing operation, the time bar period for recourse action by the 1971 Fund against the owner of the tug that carried out the towing operation would under the law of the United Arab Emirates be two years, instructed the Director to commence legal action against the owner of the tug (Falcon 1) within two years of the date of the incident.
