In October 1998 the 1992 Fund Assembly decided to set up its 2nd intersessional Working Group, to study the application of the 1992 Conventions to floating storage units (FSUs) and floating production storage and offloading units (FPSOs). It was agreed that the Working Group would be held in public and that all Member States of the 1971 Fund and 1992 Fund, as well as States and organisations having observer status with the 1992 Fund, should be invited to participate. The Assembly agreed, at the request of the Executive Committee, that the Working Group should also consider the interpretation of the definition of ‘ship’ in the 1992 Civil Liability Convention in respect of the question that had arisen in relation to the incident involving the unladen tanker Santa Anna.
