In March 2007 the 1992 Fund Executive Committee noted that in February 2007 the Civil Court in Saint-Nazaire had rendered a judgement in respect of claims by a fisherman for loss of income between January and June 2000, additional bank and social charges and mental suffering. It was noted that the Fund had assessed the claim for loss of income, but had been informed that the claimant had already received compensation for these losses from the French Government, and since the Government had acquired the claimant’s rights by subrogation, the Fund had paid the French Government. It was noted that the Court had held that, after taking into account the amounts received by the Government, the Fund should pay compensation to the claimant in the amount £1 900. The Committee noted that the Court had considered that the claimant had failed to prove that he had suffered additional bank and social charges and had been unable to justify the reason or the quantum of the claim for mental suffering.
