In March 2007 the 1992 Fund Executive Committee noted that in December 2006 the Commercial Court in La Roche sur Yon had rendered a judgement in respect of a claim by the owner of a restaurant in Noirmoutier for losses suffered in 2000, which had been rejected by the Fund, since it had considered that the claimant’s turnover in 2000 had increased in relation to 1999 and that the claimant had benefited from the incident as a result of additional meals provided to fire brigade personnel who had carried out clean-up operations. It was noted that the Court, after stating that the Fund’s admissibility criteria were not binding on the judge, had held that it had not been demonstrated that the claimant had suffered a loss as a result of the incident and had rejected the claim.
