In October 2006 the 1992 Fund Executive Committee noted that in September 2006 the Commercial Court in Saint Brieuc had rendered a judgement in respect of claims by the owners of two commercial properties for losses suffered in their activity of seasonal lettings to businesses in the tourism sector, which had been rejected by the Fund on the grounds that they were ‘second degree’ tourism claims. It was noted that the Court had rejected the claims on the grounds that the claimants’ business had only an indirect link with tourists and that the claimants had not proved that they had suffered a loss.
