In October 2003 the 1992 Fund Executive Committee noted that the owner of the Alambra had appealed against a water pollution fine imposed by the Swedish Coastguard on the grounds that the authorities did not have jurisdiction and that there had been no discharge of oil from the Alambra. It was noted that in July 2002 the Stockholm District Court dismissed the shipowner’s request for dismissal and that in September 2002 the Stockholm Court of Appeal had upheld the District Court’s decision. It was further noted that the shipowner had lodged appeal against this decision and that in May 2003 the Supreme Court had granted the shipowner the right to bring the matter before it.
