In May 2006 the 1992 Fund Executive Committee noted that in March 2006 the Commercial Court in Lorient had rendered a judgement in respect of a claim by the owner of a bar, restaurant and hotel for loss of income allegedly suffered in 2000 as a result of the incident. It was noted that the Fund had rejected the claim for the losses suffered by the bar and restaurant, but had assessed and approved the loss in the hotel business. It was noted that the Court, having stated that it was not bound by the Fund’s admissibility criteria, nevertheless agreed with the Fund’s assessment of the claim in respect of the hotel business and rejected the claim for the restaurant and bar, since these businesses had started to decline two years before the incident.
