In March 2006 the 1992 Fund Executive Committee noted that in October 2005 the Commercial Court in Rennes had rendered a judgement in respect of a claim by the owner of company operating taxi boats. It was noted that at the claimant’s request the Civil Court in Sable d’Olonne had appointed a court expert to determine his loss, that the Fund had paid compensation on the basis of the expert’s report for the period 25 December 1999 – 13 August 2001 and that the claimant had signed a settlement agreement. It was noted that the claimant had subsequently submitted a claim to the Commercial Court in Rennes for loss of income in 2001, maintaining that the settlement agreement did not preclude him from claiming for losses which the settlement had covered. It was noted that the Court had rejected all claims for the period 25 December 1999 – 13 August 2001, but accepted the claim for losses suffered during the period 14 August 2001 – 31 October 2001, which was not covered by the settlement agreement. It was noted that the Fund had not appealed against the judgement and had paid the amount determined by the Court.
