In October 2005 the 1992 Fund Executive Committee noted that in June 2005 the Commercial Court in Rennes had rendered a judgement in respect of a claim by a company making signposts for hotels and other businesses for losses allegedly suffered in the years 2000 and 2001 due to the incident. It was noted that the Fund had rejected the claim on the grounds that the claimant provided services to other businesses in the tourist industry and not directly to tourists, and that for this reason, there was not a sufficient link of causation between the contamination and the alleged loss. The Committee noted that the Court had found that the claimant’s business had declined considerably since 1997, well before the incident took place, and had concluded that there was no direct link of causation between the reduction in turnover from 1997 to 2000 and the incident, and that for these reasons the Court had rejected the claim.
