In June 2005 the 1992 Fund Executive Committee noted that in the same month the Civil Court in Saint-Nazaire had rendered a judgement in respect of a claim by a company owning five shops selling sports clothing and accessories in La Baule for losses allegedly suffered in 2000 as a result of the incident, which had been assessed by the Fund and a provisional payment had been made to the claimant. It was noted that part of the claim related to losses resulting from the closure of one of the shops due to a reduction in turnover allegedly as a consequence of the incident. It was noted that the Court had held that the claimant had not proved that the reduction in sales was due to the incident and that as regards the other part of the claim, the claimant had failed to prove that he had suffered a more significant loss due to the incident than that assessed by the Fund.
