In March 2005 the 1992 Fund Executive Committee noted that in November 2004 the Commercial Court in Vannes had rendered a judgement in respect of a claim for loss of revenue and moral damages (related to stress) by the owner of a grocery store located 200 metres from the shore in the Department of Morbihan. It was noted that the Fund had accepted that the claim for loss of revenue was admissible in principle, but for a considerably lower amount than claimed, and had rejected the claim for moral damages, since such claims were not admissible under the Conventions. The Committee noted that the Court had upheld the Fund’s assessment of the loss of turnover and had agreed that the claim for moral damages fell outside the scope of the Conventions.
