In May 2004 the 1992 Fund Executive Committee decided that since the evidence provided by the authorities in Bahrain pointed overwhelmingly to the source of the pollution having been a ‘ship’ as defined in the 1992 Conventions, claims arising from the incident were covered by the 1992 Fund Convention and that the claims by the Bahrain authorities were admissible in principle.
