In October 2002 the 1992 Fund Executive Committee noted that in June 2002 the Federal Republic of Germany had taken legal action against the 1992 Fund in order to prevent its claim against the Fund becoming time barred at the expiry of a period six years from the date of the incident as set out in Article 6 of the 1992 Fund Convention. It was also noted that the Fund had applied to the Court to stay the proceedings in respect of this action pending the outcome of the action by the Federal Republic of Germany against the shipowner/insurer.
