In March 2001 the 1971 Fund Administrative Council decided, on the basis of the claims pending in the courts and settled claims, which showed that the 1971 Fund’s exposure stood at £107 million, to increase the level of the Fund’s payments to 40% of the loss or damage actually suffered by each claimant. The Council also authorised the Director to increase the level to 70% if the Fund’s exposure fell below £67 million and to between 40% and 70% if and to the extent that actions withdrawn from the courts would allow it.
