In February 1999 the 1971 Fund Executive Committee considered the admissibility of a claim by Elf UK Oil Ltd for the cost of preparing a tanker to enable it to be used for the emergency lightering of the Sea Empress. The Committee decided that the claim related to operations that had a dual purpose of salvage and pollution prevention and that 50% of the costs should be considered as admissible in principle. The Committee emphasised that the cost of dual purpose operations should not automatically be apportioned on a 50:50 basis, but that the apportionment should be based on a case-by-case examination.
