In April 1998 the 1971 Fund Executive Committee decided that, subject to an acceptance being given by the Spanish Government that the Spanish State was in any event liable to pay the total amount of the established claims in excess of the maximum amount available under the 1969 Civil Liability and 1971 Fund Conventions,namely 60 million SDR, there would be no risk of overpayment by the Fund and that the Fund should therefore pay 100% of the amounts awarded by the Court of Appeal in respect of individual claims as well as 100% of the amounts established in final out-of-court settlements.
