In December 1995, in a private session at which only the representatives of 1971 Fund Member States were present, the 1971 Fund Executive Committee decided to postpone its decision as to whether and, if so, to what extent the Fund should be exonerated from its obligation to pay indemnification, but invited the Director to discuss the issue with the shipowner and his insurer and to suggest that they consider not pressing for indemnification.
