In October 1985 the 1971 Fund Executive Committee considered the question of whether and to what extent the costs of the salvage operations fell within the definition of ‘pollution damage’ and in particular what criteria should be applied in order to determine whether measures which could be considered as having a dual purpose, ie both to prevent oil pollution and to preserve the hull and cargo, should be regarded as covered by the definiition of ‘preventive measures’. The Committee decided not to take any firm position, but instructed the Director to report to the October 1986 session on the developments in respect of the incident.
